1. Agreement to Terms

By accessing or using Fill The Chair ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

These Terms apply to all users of the Service, including salons, barbershops, their staff, and administrators.

2. Description of Service

Fill The Chair is a salon and barbershop booking software that provides:

Booking scheduling and management
Client waitlist management
Automated SMS and email booking reminders
Business analytics and reporting
Online booking confirmation for clients

3. User Accounts

When you create an account, you must provide accurate and complete information. You are responsible for:

Maintaining the security of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorised access
Ensuring all users in your business comply with these Terms

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payment

4.1 Free Trial

New accounts receive a 7-day free trial. No payment is required during the trial period. At the end of the trial, you must subscribe to continue using the Service.

4.2 Subscription Plans

We offer the following subscription:

Full Access (£19.99/month): Unlimited clients, unlimited SMS, all features included

4.3 Billing

Subscriptions are billed monthly in advance. All fees are exclusive of VAT, which will be added where applicable. Payments are processed securely by Stripe.

4.4 Cancellation

You may cancel your subscription at any time through your billing settings. Upon cancellation:

Access continues until the end of your current billing period
No refunds are provided for partial months
Your data will be retained for 30 days, then deleted

5. Acceptable Use

You agree NOT to:

Use the Service for any unlawful purpose
Upload or transmit viruses or malicious code
Attempt to gain unauthorised access to our systems
Interfere with or disrupt the Service
Use the Service to send spam or unsolicited communications
Impersonate another person or entity
Collect client data for purposes other than booking management
Share your account credentials with unauthorised parties
Resell or redistribute the Service without permission

6. Data Protection and GDPR

6.1 Your Responsibilities

As a salon or barbershop using our Service, you are the Data Controller and are responsible for:

Obtaining appropriate consent from clients for SMS/email communications
Ensuring the accuracy of client data you enter
Responding to client data access or deletion requests
Complying with all applicable data protection laws

6.2 Our Responsibilities

As your Data Processor, we will:

Process data only according to your instructions
Implement appropriate security measures
Assist you in responding to data subject requests
Notify you of any data breaches without undue delay
Delete or return data upon termination of service

7. SMS and Email Communications

Our Service sends booking reminders and notifications to clients via SMS and email. By using the Service, you confirm that:

You have obtained client consent to receive these communications
Client contact details are accurate and up-to-date
You will promptly honour any client requests to opt out

SMS usage is subject to your subscription tier limits. Unused SMS allowances do not roll over.

8. Intellectual Property

The Service, including all content, features, and functionality, is owned by Fill The Chairand is protected by copyright, trademark, and other intellectual property laws.

You retain all rights to your data. By using the Service, you grant us a limited licence to process your data solely to provide the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Merchantability or fitness for a particular purpose
Uninterrupted or error-free operation
Accuracy or reliability of any information
Compatibility with your systems or requirements

We do not guarantee SMS or email delivery, as this depends on third-party providers and recipient network conditions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FILL THE CHAIR SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Missed bookings or client no-shows
Failure of SMS or email delivery
Errors in client data entered by users

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Fill The Chair, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Client data you process through the Service

12. Termination

We may terminate or suspend your access immediately, without prior notice, for:

Breach of these Terms
Non-payment of fees
Suspected fraudulent or illegal activity
Extended periods of inactivity

Upon termination, your right to use the Service ceases immediately. You may request a data export within 30 days of termination.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by email or through the Service at least 30 days before they take effect.

Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
